San Juan Capistrano Dirt Bike Riders Motorcycle Accident case begins
A jury in a court in Santa Ana will begin to hear opening statements in short of the two lawyers in a case that threatens to become a very emotional one â € "the negligence of the city, on the one hand, and parental supervision, or lack thereof, in the other.
Lawyers for both sides of a motorcycle accident, have begun to present arguments before the opening of the Prospective jurors in the case of San Juan Capistrano two teenage children. On March 30, 2005, the two teenagers, Trenton Merrill, after 14 years of age, and Scott Agostini, then 13 years of age were bicycling. Merrill was the passenger. The couple crossed the San Juan Capistrano Creek Road, and crashed into a BMW. Both injuries in a motorcycle accident, but it was Merrill, who bore the brunt of the impact. He spent several weeks in hospital, suffering a series of surgeries before his leg had to be amputated. Agostini was discharged a week after the accident without permanent damage. The driver of the BMW, Emily Pastore, was not injured in the accident.
In the days after the motorcycle accident, Merrill and his family sued the city and a landscape contractor in the city. The city, meanwhile, demanded both Agostini and Pastore, but last week demand fell Pastore.
In the opening address, counsel for the city from its arguments on youth and temperament. He said the boys had been encouraged to take the sport of motocross racing by his parents, and tended to use the neighborhood how private motocross track. There was no record of any maintenance work done on the scene by the landscape contractor. There were no warning signs that could have warned the boys. There was nothing but green bushes that block the buoy ™ € s of view, and caused a motorcycle accident.
The case has taken on emotional tones, especially those parents who believe that boys € ™ stop being irresponsible riding of dirt bikes on the streets. The city attorney actually used the words, â € œself centeredâ €, and â € € œdisobedient.â Wea € ™ re still a while out of sight all the facts in this case, but there doesn t ™ € seems have no evidence that the children were in the habit of using the streets as a racetrack, as the city ™ € s lawyer said. The neighbors of the Agostinis say that most of the ™ € boys horse was at the race track that his parents had built for him in the yard.
Itâ € ™ s ridiculous pile all the blame on the parents, when the city has managed to keep the streets safe for people to use. It seems as if the city is trying to blame others without acknowledging that also has a role to play in this tragedy. True, the boys can not have had a place on the roads, but then, a large brush didnâ € ™ t have a place in the media center that day either.
